General terms and conditions - Silent Disco rental

2.3 Enterprises: organizational associations, aimed at sustainable participation in economic activity by means of labor and capital and with the intention of making a profit in the exercise of a profession or business and which enter into a contract with RentSilentDisco.

2.4 Institutions: formally structured organizations aimed at carrying out non-profit work or promoting certain causes or projects and entering into an agreement with RentSilentDisco.

2.5 Agreement: an agreement within the framework of an agreement concluded by RentSilentDisco Organized system for supply and rental of equipment.

2.6 Equipment: Headphones, transmitters and cords rented by RentSilentDisco for the purpose of a silent disco organized by consumers, institutions and businesses.

2.7 Withdrawal period: the period within which your right of withdrawal can be exercised.

2.8 Right of withdrawal: the possibility of renouncing an agreement within the specified cooling-off period.

2.9 Day: calendar day.

Article 3 - Applicability.

3.1 These general terms and conditions apply to all quotations from RentSilentDisco, and purchase of products by you and to any agreement reached between you as a consumer, business or institution and RentSilentDisco. Upon request, we will send you a written copy.

3.2 By placing an order, you indicate your agreement with the terms of delivery and payment. RentSilentDisco reserves the right to change its delivery and/or payment terms after the expiration of the term.

3.3 Unless otherwise agreed in writing, the general or specific terms and conditions or stipulations of third parties shall not be considered by RentSilentDisco acknowledged.

3.4 RentSilentDisco guarantees that the delivered product conforms to the agreement and meets the specifications stated in the offer.

Article 4 - The Agreement

4.1 An agreement between RentSilentDisco and a customer is established after an application is received by RentSilentDisco has been assessed for feasibility.

4.2 RentSilentDisco reserves the right, without giving reasons, not to accept applications or to accept them only under the condition that the shipment is made cash on delivery or after advance payment.

Article 5 - Right of withdrawal

5.1 When renting equipment, you have the option of dissolving the agreement without giving reasons for seven working days, starting on the day of entering into the agreement. Dissolution can take place until the moment of actual delivery of the material.

5.2 You may exercise your right of withdrawal in accordance with the instructions provided with the offer and/or upon delivery.

5.3 In the event you wish to avail yourself of revocation, you must notify us in writing by e-mail to info@huursilentdisco.nl

5.4 Up to four weeks before the delivery date of materials, the right of withdrawal may be exercised free of charge. If the provision of a service is revoked in a time frame less than four weeks before the agreed delivery date, the following percentage of the agreed fee will be charged:

Between two weeks and one week before the agreed upon date: 15%;
Within 7 to 4 days before the agreed date: 25%;
Within 3 days before the agreed upon date: 50%;

Costs will be charged in the above cases in connection with the reservation of the material and the risk of loss of revenue due to the withdrawal.

Article 6 - Rates

6.1 If a quotation has a limited period of validity or is made subject to conditions, this shall be expressly stated in the quotation.

6.2 Rates will not be increased within the term of the offer, unless legal measures make it necessary.

6.3 All rates on the site are subject to printing and typesetting errors. No liability is accepted for the consequences of printing and typesetting errors.

6.4 All rates in the offer and on the site are fixed, in Euros and including 21% VAT unless otherwise stated.

Article 7 - Warranty and Conformity

7.1 HuurSilentDisco guarantees that the material offered conforms to the specifications stated in the offer, to the reasonable requirements of soundness and to the legal provisions and/or government regulations existing on the date of the conclusion of the agreement.

7.2 If it turns out that the delivered material is defective, the buyer (before proceeding to return it to RentSilentDisco ) report these defects in writing within 14 days of discovery of the defect to RentSilentDisco .

7.3 RentSilentDisco is not liable for damage caused by intentional or equivalent deliberate recklessness by the Customer or any person in possession of the material delivered, whether or not with the consent of the Customer.

7.4 Warranty cannot be granted if the customer has made changes to the material or if the material has suffered damage due to intentional or negligent maintenance.

Article 8 - Images and specifications

8.1 All images; photographs, drawings, etc.; including data on weights, dimensions, colors, images of labels, etc. on the Internet site of RentSilentDisco are only approximate, indicative and cannot be a reason for compensation or dissolution of the agreement.

Article 9 - Liability

9.1 RentSilentDisco is not liable for any injuries sustained by or because of the equipment provided.

9.2 If RentSilentDisco must compensate any damage for any reason, such compensation shall never exceed the amount equal to the invoice value of the material supplied.

Article 10 - Delivery and execution

10.1 RentSilentDisco will at all times handle with care the material to be delivered, received and reviewed.

10.2 The product will always be protected as much as possible before shipping. Since the products are fragile, take RentSilentDisco additional precautions. The material is carefully packed.

10.3 RentSilentDisco aims to accepted orders for products expeditiously but at the latest within 30 days unless a longer delivery period is agreed. If the order can not or only partially be executed, you will receive notice of this at the latest one month after you placed the order. In that case you have the right to dissolve the agreement without cost.

10.4 In the event of dissolution in accordance with paragraph 3 of this article, the RentSilentDisco Refund the amount you paid as soon as possible, but no later than 30 days after dissolution

10.5 The place of delivery, once shipping has been chosen, is the shipping address that the customer provides to RentSilentDisco passed on the site.

10.6 For delivery via parcel post RentSilentDisco not liable for any delays in shipments.

10.7 Once the choice is made to pick up the products, it should be done with RentSilentDisco an appointment to be made. We will contact you a few days before the rental period to indicate when we will be there.

10.8 Under no circumstances shall a customer, company or institution be permitted to make use of RentSilentDisco rented materials or to make them available to third parties, or to repair and/or dismantle them.

10.9 In case of rental, you will take care of the rented materials and equipment, secure them adequately and use them in accordance with the (user) instructions. You are responsible for all possible (irreparable) damage/or loss of materials and equipment in accordance with article 11 from the moment of arrival/receipt until the moment of departure/return.

10.10 A consumer, company or institution indemnifies HuurSilentDisco against any third party claims for damages related to the use of rented materials.

10.11 RentSilentDisco reserves the right to grant individuals, organizations, companies and institutions access to the services of RentSilentDisco denial. This will occur in cases of complaints related to, for example, insult, harassment of any kind, stalking or other improper behavior.

Article 11 - Damaged material

11.1 Before and after, the materials rented by us are thoroughly checked to ensure proper operation of the materials.

11.2 Rented materials during the rental period are not by RentSilentDisco insured. You must take out your own adequate insurance for, among other things, (irreparable) damage, loss and theft of rented materials.

11.3 In case damage is found after return, costs for necessary repairs and/or missing materials will be charged to the final invoice.

11.4 If the previous paragraph is applicable, in case of a headset missing and/or rendered unusable, €40,- will be charged. In case of a transmitter that is missing or unusable, €60 will be charged. For other materials such as cords, the new price will be charged on the final invoice.

Article 12 - Payment

12.1 Payments for the delivery of materials for which a quotation has been sent shall be made by invoice. RentSilentDisco will indicate the payment term on the invoice.

12.2 The amounts due to the buyer, to be found on the invoice, must be paid within 14 days.

12.3 The payment method for the amount due can be paid by iDEAL, Credit Card, Bank Transfer or by Cash/PIN at pickup or return.

Article 13 - Privacy

13.1 RentSilentDisco takes the management of personal data very seriously to protect your privacy.

13.2 In order to properly perform our services, we submit RentSilentDisco records your data when information or an offer is requested by phone, by e-mail or through the website, a contract is entered into or otherwise contact is made with RentSilentDisco and in case you provided additional data.

13.3 The data will be used for sending mailings and other information, for being able to send offers and invoices, for being able to execute issued orders, payments via iDeal and to comply with legal obligations.

13.4 If you wish to inspect, rectify or delete registered data, you can make this known via the website. We will respond in that case as soon as possible, but no later than 4 weeks after receipt.

13.5 Data will be provided with your consent by RentSilentDisco managed until such time as you indicate that you no longer find it desirable or until such time as RentSilentDisco no longer deems it necessary to retain the data.

13.6 Data will be kept on computers.

13.7 When a telephone number or e-mail address is made known in connection with, for example, a response, question or complaint, you automatically agree that it will be used by RentSilentDisco contact can be made at that phone number or e-mail address to address the substance of the response, question or complaint.

Article 14 - Complaints procedure

14.1 Complaints about the performance of the agreement must be submitted to the entrepreneur within a reasonable time, fully and clearly described, after the consumer has identified the defects.

14.2 The customer shall be obliged to carefully inspect the products (or have them inspected) immediately upon receipt. Complaints from the customer relating to defects to the product or the delivery, which are externally perceptible, must be notified by the customer within three days after delivery to the Customer. Article 15 - Disputes

15.1 Contracts between the entrepreneur and the consumer to which these general conditions relate are exclusively governed by Dutch law.
